Our Constitutional Rights
Citizens are supposed to be treated equally under the law, which means that if a law forbids an action, such a rape, no one should get a pass because of their fame or position. Sadly, we know this isn’t the way things work. If you have money, power or fame, you are likely to get off while poor people are more likely to get severe punishment. And in CA, you can get off if you are here illegally. No one actually understands this one.
Some of the laws Biden has pushed have sought to remedy this, such as the no-bail rules or appointing more lenient DAs. However, this isn’t working out very well. No-bail might make sense for lesser offenses if the person is a first time criminal. Once they’ve been convicted, bail is appropriate. And letting people off after they’ve harmed others or taken their property only encourages more crime.
Instead, judges and prosecutors must be instructed to be “blind” to the defendant’s standing. If person A does something and gets a penalty, person B should be treated the same.
How It’s Actually Working Out
The latest atrocity is the Hunter Biden case. He lied on the federal forms for purchasing a gun; he was a user of illegal drugs and you must attest that you do not. The charge should be a 4th degree felony (up to 18 months in prison and $5000 in fines) or a 5th degree felony (up to 12 months in prison and up to $2500 fine). In most cases, the defendant, even if pleading guilty, would get some fine and probably some prison time. They would also permanently lose the right to own a weapon.
He owed $1.2MM in unpaid taxes and it isn’t clear that this was simply a misunderstanding of the tax law. Fraud always carries a prison sentence. And given the amount, he should have received a stiff penalty. Anyone else would have been put in prison. He’s getting a pass because of his name. Also, any DA or even the Attorney General, should have gone after him because of the information of the influence peddling shown on his laptop.
Also, a drug user, Prince Harry lied on his visa application. Normally, this means deportation, but…famous people get a pass. (Unless they are Republicans). No doubt he was a drug user. He advertised it in his book.
Hilary Clinton has gotten a pass on many crimes, all likely provable. The Clinton Foundation was funded by influence peddlers and the money was often raided for personal expenses. She exposed secrets to the world which likely have long-term ramifications, a far greater crime than taking home some documents. Going back through her history, many other crimes have gone unpunished. Her financial affairs were far sketchier than Martha Stewart. But she remains free.
Trump is constantly being attacked and yet, he was President when he took documents to his home. Was he wrong? Yes, but he didn’t pack the boxes and there’s no evidence anyone else had access. Biden was a Senator and then a VP when he took confidential information home. Hunter, (and perhaps others), had free access and yet, no one is going after him. (Too scared that this might result in a Harris presidency?)
And let’s face it. If you rape someone, but you’re famous, you will get off. After all, she had to want to say she had sex with you, didn’t she?
Changes Needed
No special treatment should be given to politicians, relatives of politicians, celebrities, or to other famous people or their families. State Bars should investigate judges and DAs to look for unfair treatment and force change. The loss of a license to practice could be assessed when a repeat offender offers better treatment to the famous while throwing the book at a regular person. When you fine a wealthy person $1000, that’s chump change. When you fine a poor person the same amount, people in the family may not be able to stay in their home. In terms of fines, perhaps they should be graduated based on ability to pay. That should be popular with the Left; they want to tax the wealthy more.
There should also be an independent federal Bar that looks at federal convictions. Sure, the DOJ should do this, but they are political appointments, and the current employees lean way too far to the Left. Many are pretty safe from being fired, so we can’t get the turnover we need.
We need a fair system of law. I’d love to see them set an example with Hunter Biden. And perhaps throw out all suits against Trump, as there are two many Democrats who have committed the same or worse “crimes” without even being charged.
Of course. And now, there is more evidence of the Biden crime family's crimes. Wonder if anything will happen?
And these same people who are guilty of these crimes continue to opine in public. Their audacity is overwhelming.
